Code § 12-13-14","heading":"Chief Clerk of Probate Court - Powers Generally; Authority for Performance of Official Acts of Chief Clerk Generally.","body":"(a) The chief clerk shall have the following powers:\n(1) To issue letters testamentary, of administration and of guardianship, where there is no contest.\n(2) To administer oaths relating to the business of the court and to take and certify acknowledgments and proof of instruments authorized to be recorded.\n(3) To solemnize matrimony, approve bonds and appoint guardians ad litem.\n(4) To admit wills to probate and record and to pass and allow accounts of executors, administrators and guardians, where there is no contest.\n(5) To do all other acts and things and perform all other duties, ministerial and judicial, where there is no contest, that the probate judge may do and perform.\n(b) All of the official acts of such chief clerk must be performed in the name of the probate judge, except when there is a vacancy in that office.","path":["Title 12 Courts.","Chapter 13 Probate Courts.","Article 1 General Provisions."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=12-13-14","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:52Z","sha256":"43bd2099228dda0e8350304b9a19e07ae4472cf24cec46df578f04134f4f0113","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-12-13-13","next":"us-al/ala.-code-12-13-15"},"notice":"GroundRules: Original legal text.
