Code § 13A-10-193.2","heading":"Destructive Device or Bacteriological or Biological Weapon - Unlawful Manufacture in the First Degree.","body":"(a) A person commits the crime of unlawful manufacture of a destructive device or bacteriological or biological weapon in the first degree if he or she violates Section 13A-10-193.1 and two or more of the following conditions occur in conjunction with that violation:\n(1) Use of a booby trap or manufacture of a booby trap.\n(2) Illegal possession, transportation, or disposal of hazardous or dangerous materials or while transporting or causing to be transported materials in furtherance of a clandestine laboratory operation, there was created a substantial risk to human health or safety or a danger to the environment.\n(3) A clandestine laboratory operation was to take place, or did take place, within 500 feet of a residence, place of business, church, or school.\n(4) A clandestine laboratory operation actually produced any amount of a specified destructive device or bacteriological or biological weapon.\n(5) A person under the age of 17 was present during the manufacturing process.\n(b) Unlawful manufacture of a destructive device or bacteriological or biological weapon in the first degree is a Class A felony.","path":["Title 13A Criminal Code.","Chapter 10 Offenses Against Public Administration.","Article 9 Biological and Bacteriological Weapons."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=13A-10-193.2","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:53Z","sha256":"50d1af6bee09a10eaeeb89721e52f7908d9386f6e3721838063eecac35dfea31","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-13a-10-193.1","next":"us-al/ala.-code-13a-10-194"},"notice":"GroundRules: Original legal text.
