Code § 13A-10-242","heading":"Making a Terrorist Threat in the Second Degree.","body":"(a) A person commits the crime of making a terrorist threat in the second degree when he or she makes a credible threat to commit a violent act against a person or to damage any property by use of a bomb, explosive, weapon of mass destruction, firearm, deadly weapon, dangerous instrument, or other mechanism.\n(b)(1) Except as provided in subdivision (2), the crime of making a terrorist threat in the second degree is a Class A misdemeanor.\n(2) The crime of making a terrorist threat in the second degree is a Class D felony if either of the following occurs:\na. The person has a prior adjudication or conviction of making a terrorist threat in any degree.\nb.
