Code § 13A-8-35","heading":"Exceptions.","body":"This article shall not apply to purchases of metal property from any of the following:\n(1) A law enforcement officer acting in an official capacity unless the law enforcement officer is investigating a compliance issue pursuant to this article or is presenting metal property for sale.\n(2) A trustee in bankruptcy, executor, administrator, or receiver who has presented proof of such status to the secondary metals recycler.\n(3) Any public official acting under a court order who has presented proof of such status to the secondary metals recycler.\n(4) A sale or the execution, or by virtue, of any process issued by a court if proof thereof has been presented to the secondary metals recycler.\n(5) A manufacturing, industrial, or other commercial vendor that generates or sells regulated metal property in the ordinary course of its business.\n(6) A municipal, county, state, federal, or other governmental entity.\n(7) A utility company.\n(8) A funeral home or the owner or operator of a cemetery.","path":["Title 13A Criminal Code.","Chapter 8 Offenses Involving Theft.","Article 1A Secondary Metal Recycling."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=13A-8-35","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:52Z","sha256":"464e8e95a0843a69f275b1f3d462b22676f8a218a44c104558308c126e27b97a","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-13a-8-34","next":"us-al/ala.-code-13a-8-35.1"},"notice":"GroundRules: Original legal text.
