Code § 19-3B-1012","heading":"Protection of Person Dealing with Trustee.","body":"(a) A person other than a beneficiary who in good faith assists a trustee, or who in good faith and for value deals with a trustee, without knowledge that the trustee is exceeding or improperly exercising the trustee’s powers is protected from liability as if the trustee properly exercised the power.\n(b) A person other than a beneficiary who in good faith deals with a trustee is not required to inquire into the extent of the trustee’s powers or the propriety of their exercise.\n(c) A person who in good faith delivers assets to a trustee need not ensure their proper application.\n(d) A person other than a beneficiary who in good faith assists a former trustee, or who in good faith and for value deals with a former trustee, without knowledge that the trusteeship has terminated is protected from liability as if the former trustee were still a trustee.\n(e) Comparable protective provisions of other laws relating to commercial transactions or transfer of securities by fiduciaries prevail over the protection provided by this section.","path":["Title 19 Fiduciaries and Trusts.","Chapter 3B Alabama Uniform Trust Code."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=19-3B-1012","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:52Z","sha256":"bba81c1608778d5472a8d919dcd562c90655bfc535527a8569ebc7300c71e982","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-19-3b-1011","next":"us-al/ala.-code-19-3b-1013"},"notice":"GroundRules: Original legal text.
