Code § 19-3B-305","heading":"Appointment of Representative.","body":"(a) If the court determines that an interest is not represented under this article, or that the otherwise available representation might be inadequate, then the court may appoint a guardian ad litem or other representative to receive notice, give consent, and otherwise represent, bind, and act on behalf of a minor, incapacitated, or unborn individual, or a person whose identity or location is unknown.\n(b) A guardian ad litem or other representative may act on behalf of the individual represented with respect to any matter arising under this chapter, whether or not a judicial proceeding concerning the trust is pending.\n(c) In making decisions, a guardian ad litem or other representative may consider general benefit accruing to the living members of the individual’s family.\n(d) A guardian ad litem or other representative may be appointed to represent several persons or interests.","path":["Title 19 Fiduciaries and Trusts.","Chapter 3B Alabama Uniform Trust Code."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=19-3B-305","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:52Z","sha256":"619a534f6bf1c4628f47bcb4d9abe9d94b6efdc7c9642e8aec5f90144968c52e","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-19-3b-304","next":"us-al/ala.-code-19-3b-401"},"notice":"GroundRules: Original legal text.
