Code § 19-3B-706","heading":"Removal of Trustee.","body":"(a) The settlor, a co-trustee, or a beneficiary may request the court to remove a trustee, or a trustee may be removed by the court on its own initiative.\n(b) The court may remove a trustee if:\n(1) the trustee has committed a serious breach of trust;\n(2) lack of cooperation among co-trustees substantially impairs the administration of the trust;\n(3) because of unfitness, unwillingness, or persistent failure of the trustee to administer the trust effectively, the court determines that removal of the trustee best serves the interests of the beneficiaries; or\n(4)(A) there has been a substantial change of circumstances or removal is requested by all of the qualified beneficiaries;\n(B) the court finds that removal of the trustee best serves the interests of all of the beneficiaries and is not inconsistent with a material purpose of the trust; and\n(C) a suitable co-trustee or successor trustee is available.\n(c) Pending a final decision on a request to remove a trustee, or in lieu of or in addition to removing a trustee, the court may order such appropriate relief under Section 19-3B-1001(b) as may be necessary to protect the trust property or the interests of the beneficiaries.","path":["Title 19 Fiduciaries and Trusts.","Chapter 3B Alabama Uniform Trust Code."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=19-3B-706","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:52Z","sha256":"5abd9c76716759af61a21a261475ae7641d2f983bab7ca3d52611d96db2665ba","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-19-3b-705","next":"us-al/ala.-code-19-3b-707"},"notice":"GroundRules: Original legal text.
