Code § 19-3B-807","heading":"Delegation by Trustee.","body":"(a) A trustee may delegate duties and powers that a prudent trustee could properly delegate under the circumstances. The trustee shall exercise reasonable care, skill, and caution in:\n(1) selecting an agent;\n(2) establishing the scope and terms of the delegation, consistent with the purposes and terms of the trust; and\n(3) periodically reviewing the agent’s actions in order to monitor the agent’s performance and compliance with the terms of the delegation.\n(b) In performing a delegated function, an agent owes a duty to the trust to exercise reasonable care, skill, and caution to comply with the terms of the delegation.\n(c) A trustee who complies with subsection (a) is not liable to the beneficiaries or to the trust for an action of the agent to whom the function was delegated.\n(d) By accepting a delegation of powers or duties from the trustee of a trust that is subject to the law of this state, an agent submits to the jurisdiction of the courts of this state.","path":["Title 19 Fiduciaries and Trusts.","Chapter 3B Alabama Uniform Trust Code."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=19-3B-807","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:52Z","sha256":"e45da4abcead06e35d05b5fef72224aeee3a284d2e5e41f0188128ca8ce88d27","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-19-3b-806","next":"us-al/ala.-code-19-3b-808"},"notice":"GroundRules: Original legal text.
