Code § 19-3E-3","heading":"Jurisdiction and Venue.","body":"(a) Except as provided in subsection (b), the circuit court has exclusive jurisdiction over an action that addresses either of the following questions:\n(1) Whether a transfer is a qualified disposition.\n(2) The extent of the transferor’s interest in, or the income from, a qualified disposition.\n(b) A probate court granted statutory equitable jurisdiction has concurrent jurisdiction with the circuit court over questions described in subsection (a) and over an action brought under subsection (b) of Section 19-3E-5.\n(c) Except to the extent otherwise provided by court rule, venue for a proceeding under subsection (a) or (b) is in the following order of priority:\n(1) In any county where venue is proper for civil actions generally, pursuant to Chapter 3 of Title 6.\n(2) In a county in this state in which the current qualified trustee has its usual place of business or residence.\n(3) In a county in this state in which the immediately preceding qualified trustee had its usual place of business or residence.\n(4) In a county in this state in which any trust property subject to the qualified disposition is located.\n(5) In a county in this state in which a trust beneficiary resides.","path":["Title 19 Fiduciaries and Trusts.","Chapter 3E Alabama Qualified Dispositions in Trust Act."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=19-3E-3","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:53Z","sha256":"efe2ac84fd46e1003784cc259728a01f4f8875d88ca7e3d2ed472afe35234c3c","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-19-3e-2","next":"us-al/ala.-code-19-3e-4"},"notice":"GroundRules: Original legal text.
