Code § 34-35-2","heading":"Exemptions from Chapter.","body":"(a) The provisions of this chapter shall not apply to:\n(1) Civic and nonprofit organizations, wholesale sales to retail merchants by commercial travelers or agents selling in the usual course of business;\n(2) Wholesale trade shows or conventions;\n(3) Sales of goods, wares, services, or merchandise by sample catalogue or brochure for future delivery;\n(4) Fairs and convention center activities conducted primarily for amusement or entertainment;\n(5) Any general sale, fair, auction, or bazaar sponsored by a church or religious organization;\n(6) Garage sales held on premises devoted to residential use;\n(7) Sales of crafts or items made by hand or sold or offered for sale by the person making the crafts or items;\n(8) Duly licensed flea markets operating from a fixed location;\n(9) Sales of agricultural products, except nursery products and foliage plants; or\n(10) Sample sales made by a seller at residential premises under an invitation issued by the owner or legal occupant of the premises.\n(b) A transient merchant not otherwise exempted from this chapter is not exempted from this chapter because of a temporary association with a local dealer, auctioneer, trader, contractor, or merchant, or by conducting the transient business in connection with or in the name of any local dealer, auctioneer, trader, contractor, or merchant.","path":["Title 34 Professions and Businesses.","Chapter 35 Transient Merchants."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=34-35-2","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:52Z","sha256":"09cfd3addea373bedbcd862266037793c556f9b9017944234565f80f8c451a5b","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-34-35-1","next":"us-al/ala.-code-34-35-3"},"notice":"GroundRules: Original legal text.
