Code § 35-18-3","heading":"Actions Affecting a Conservation Easement.","body":"(a) An action affecting a conservation easement may be brought by any of the following:\n(1) An owner of an interest in the real property burdened by the easement.\n(2) A holder of the easement.\n(3) A person having a third-party right of enforcement only to the extent provided in the instrument creating the easement.\n(b) This chapter does not affect the power of a court to modify or terminate a conservation easement in accordance with the principles of law and equity applicable to other easements and specifically including the doctrine of changed conditions.","path":["Title 35 Property.","Chapter 18 Conservation Easement."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=35-18-3","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:51Z","sha256":"751279db01062550af00d37f62715a6ef0c7ab131686d357e1317eb79dfa81f7","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-35-18-2","next":"us-al/ala.-code-35-18-4"},"notice":"GroundRules: Original legal text.
