Code § 45-58-140.10","heading":"Powers.","body":"(a) The district shall constitute a public corporation, which shall have the power to do any and all acts or things necessary and convenient for carrying out the purposes for which it is created including, but not limited to:\n(1) To sue and be sued.\n(2) To have a seal and alter the same at pleasure.\n(3) To acquire, hold, and dispose of property, real and personal, tangible and intangible, or interests therein and to pay therefor in cash or on credit, and to secure and procure payment of all or any part of the purchase price thereof on the terms and conditions as the board shall determine.\n(4) To acquire, own, operate, maintain, and improve a system or systems.\n(5) To pledge all or any part of its revenues, or mortgages, or otherwise encumber, all or any part of its property for the purpose of securing the payment of the principal of and interest on any of its obligations.\n(6) To sell, lease, mortgage, or otherwise encumber or dispose of all or any of its property.\n(7) To contract debts, borrow money, and to issue or assume the payment of obligations.\n(8) To levy and collect service charges, as provided in this part and subject to limitations prescribed in this part.\n(9) To negotiate and enter into contracts with residents of areas outside the district or with other districts to furnish fire and emergency medical protection and to charge fees for service.\n(10) To merge with other fire districts created pursuant to this part.\n(11) To employ agents, servants, and attorneys.\n(12) To perform any and all of the foregoing acts and to do any and all of the foregoing things under, through, or by means of its own officers, agents, and employees or by contracts with any person, federal agency, or municipality.\n(b) The property and income of the district, all bonds issued by the district, the income from bonds, conveyances by or to the district, and leases, mortgages, and deeds of trust by or to the district shall be exempt from all taxation in the State of Alabama, including specifically the tax imposed by Section 40–21–82, as amended. The district shall be exempt from all taxes levied by the State of Alabama, any county, municipality, or other political subdivision of the state including, but without limitation to, license and excise taxes imposed in respect to the privilege of engaging in any of the activities in which a district may engage. The district shall not be obligated to pay or allow any fees, taxes, or costs to the judge of probate of any county in respect of its incorporation, the amendment of its certificate of incorporation, or the recording of any document.\n(c) The fire district shall be the primary authority having jurisdiction and responsibility in all emergency incidents occurring within the district and which are not the responsibility of law enforcement authorities.\n(d) The fire chiefs of the districts shall serve as assistants to the State Fire Marshal in the same manner as a chief of a municipal fire department pursuant to Section 36–19–3.","path":["Title 45 Local Laws.","Chapter 58 Shelby County.","Article 14 Fire Protection and Emergency Medical Services.","Part 1 Districts Created."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=45-58-140.10","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:54Z","sha256":"738909b554cfbc2a89da8cd0934053f38cf37b5ee5d2e5489472fb461af50143","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-45-58-140.09","next":"us-al/ala.-code-45-58-140.11"},"notice":"GroundRules: Original legal text.
