Code § 45-58-233.37","heading":"Legislative Intent.","body":"It is the intent of the Legislature that the provisions of this subpart pertaining to pretrial release shall be a guide to judicial officers in Shelby County to ensure that no person be needlessly detained in the county jail because of his or her personal economic circumstances or inability to post bail, provided that his or her release shall not be contrary to the public interest or a danger to the public at large, and also shall serve the purpose of assuring the presence of the defendant at trial. It is not the intent of the Legislature that this subpart be so liberally construed as to allow the indiscriminate release of accused persons. Therefore, any judicial officer may order that any eligible person incarcerated before trial or adjudication be released on an unsecured appearance bond supervised by Shelby County Community Corrections, under any conditions ordered by the judicial officer, and in accord with all of Shelby County Community Corrections’ rules and procedures. These shall include, but not be limited to, the participant reporting to Shelby County Community Corrections on a periodic basis pending adjudication, abiding by all of Shelby County Community Corrections rules and procedures, submitting to, paying for, and passing random drug and alcohol tests as directed by Shelby County Community Corrections; and to offset the costs of such a program by the participant periodically paying to Shelby County Community Corrections a reasonable supervision fee set by the commission.\nFailure to abide by any conditions may result in the participant’s bail being revoked and the participant being reincarcerated.","path":["Title 45 Local Laws.","Chapter 58 Shelby County.","Article 23 Sheriff.","Part 4 Work Release and Community Corrections.","Subpart 2 Shelby County Community Corrections Act of 2005."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=45-58-233.37","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:54Z","sha256":"fe82fd38f86037e3924181b3713f952cb09a63a5e7252b0615aecd1e97785b7e","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-45-58-233.36","next":"us-al/ala.-code-45-58-233.38"},"notice":"GroundRules: Original legal text.
