Code § 45-59-140.09","heading":"Powers of District; Bylaws.","body":"(a) The district shall constitute a public corporation, which shall have the power to do any and all acts or things necessary and convenient for carrying out the purposes for which it is created including, but not limited to, all of the following:\n(1) To sue or be sued.\n(2) To have a seal and alter the same at pleasure.\n(3) To acquire, hold, and dispose of property, real and personal, tangible and intangible, or interests therein and to pay therefor in cash or credit, and to secure and procure payment of all or any part of the purchase price thereof on such terms and conditions as the board shall determine.\n(4) To acquire, own, operate, maintain, and improve a system or systems.\n(5) To pledge all or any part of its revenues, mortgage, or otherwise encumber, all or any part of its property for the purpose of securing the payment of the principal of and interest on any of its obligations.\n(6) To sell, lease, mortgage, or otherwise encumber or dispose of all or any part of its property, as hereinafter provided.\n(7) To contract debts, borrow money, and to issue or assume the payment of obligations.\n(8) To levy and collect service charges or fees, as herein provided, subject to the limitations prescribed in this article. The fees shall not include any late fees assessed by the board.\n(9) To provide refunds of overpaid service charges and fees previously collected by the district and to otherwise correct errors made in the assessment or collection of service charges and fees.\n(10) To immediately and automatically terminate the assessment and collection of service charges and fees upon the withdrawal of a property owner from the district as provided herein and to inform the revenue commissioner and property owner in writing that the termination has occurred.\n(11) To employ agents, servants, and attorneys.\n(12) To enter into mutual assistance agreements and response and coverage agreements with municipalities and other governmental and public entities.\n(13) To perform any and all of the foregoing acts and to do any and all foregoing things under, through, or by means of its own officers, agents, and employees, or by contracts with any person, federal agency, or municipality.\n(b) This article shall constitute the articles of incorporation of the public corporation; however, the board shall adopt bylaws for the governance of the district.","path":["Title 45 Local Laws.","Chapter 59 St. Clair County.","Article 14 Fire Protection and Emergency Medical Services."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=45-59-140.09","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:54Z","sha256":"218b53f5efee2a08c33a8d2e1fd4b9de9d6497d5288022e7cc9f02845cce6b53","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-45-59-140.08","next":"us-al/ala.-code-45-59-140.10"},"notice":"GroundRules: Original legal text.
