Code § 45-59-171","heading":"Additional Fee on Matters Filed or Recorded in Probate Office; St. Clair County Mental Health Advisory Board.","body":"(a)(1) In addition to any filing or recording fee currently assessed, the Probate Office of St. Clair County shall charge an additional fee of six dollars fifty cents ($6.50) for each matter filed or recorded in the probate office. After August 1, 2021, the St. Clair County Mental Health Advisory Board may increase or lower the fee; provided, the fee may not exceed eight dollars fifty cents ($8.50).\n(2) There is established the St. Clair County Mental Health Advisory Board, which shall have five members as follows:\na. The Chair of the St. Clair County Commission, or his or her designee.\nb. The Sheriff of St. Clair County.\nc. The St. Clair County Judge of Probate.\nd. Two at-large members, who shall reside in St. Clair County and shall be nominated by the sitting members of the advisory board and appointed by the St. Clair County Commission.\n(3) By the twentieth of each month following the collection of the fee, the proceeds of the fee shall be disbursed by the judge of probate to the county commission. The fees collected under this section shall be expensed as the advisory board directs and shall be expended for crisis intervention services, which may include, but are expressly not limited to, any of the following:\na. A mental health officer; necessary equipment, supplies, and training, including an appropriately equipped vehicle; assistant mental health officers; and support staff.\nb. Admissions at a certified psychiatric inpatient unit, which shall be directed or approved by the judge of probate, the mental health officer, or an assistant mental health officer.\nc. Crisis intervention programs provided through the advisory board.\nd. Salaries of the mental health officer, assistant mental health officers, and support staff; purchases of equipment; and payment of other expenses related to mental health related services and treatment.\ne. Contracting with other entities for services that would otherwise be provided by the mental health officer or assistant mental health officers.\nf. The purchase of other necessary services or expenses, including, but not limited to, the obtaining of liability insurance for the advisory board, its members, and its employees.\n(b) No later than November 1 of each calendar year, the advisory board shall submit to the county commission a written report of all income received under this section and the itemized expenditures of the income so received for the preceding fiscal year.\n(c) The advisory board, board members, mental health officer, and assistant mental health officers shall enjoy the same immunity afforded to them pursuant to the Constitution of Alabama of 2022, or those immunities provided under Section 36–1–12.\n(d) The advisory board shall oversee the implementation of the mental health officer crisis intervention procedures.\n(e) The advisory board shall give notice of employment positions and hire any employment positions the board deems necessary to effectuate the intent of this section, including mental health officers, assistant mental health officers, and support staff in accordance with the posting and hiring policies utilized by the sheriff’s office.\n(f) The advisory board shall provide additional specialized training related to crisis intervention, mental health center operations, and the evaluation of persons suspected to be mentally ill to the mental health officer, and assistant mental health officers, if any.","path":["Title 45 Local Laws.","Chapter 59 St. Clair County.","Article 17 Health and Environment.","Part 2 Mental Health."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=45-59-171","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:54Z","sha256":"2aa2a8dbbf29d7dfc201df1bf18c38960eee6ef14f2546d5ac2b58a81125048a","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-45-59-170.01","next":"us-al/ala.-code-45-59-171.01"},"notice":"GroundRules: Original legal text.
