Code § 6-6-26.08","heading":"Disqualification of Collaborative Lawyer and Lawyers in Associated Law Firm.","body":"(a) Except as otherwise provided in subsection (c), a collaborative lawyer is disqualified from appearing before a tribunal to represent a party in a proceeding related to the collaborative matter. This disqualification is not subject to waiver by the parties.\n(b) Except as otherwise provided in subsection (c), a lawyer in a law firm with which the collaborative lawyer is associated is disqualified from appearing before a tribunal to represent a party in a proceeding related to the collaborative matter if the collaborative lawyer is disqualified from doing so under subsection (a) or other court order.\n(c) A collaborative lawyer or a lawyer in a law firm with which the collaborative lawyer is associated may represent a party:\n(1) to ask a tribunal to approve an agreement resulting from the collaborative law process and prepare and file all documents necessary to obtain a final order; or\n(2) to seek or defend an emergency order to protect the health, safety, welfare, or interest of a party, or the party’s child including, but not limited to, a proceeding filed under the Protection from Abuse Act, Chapter 5 of Title 30, if a successor lawyer is not immediately available to represent that person.\n(d) If subsection (c)(2) applies, a collaborative lawyer, or lawyer in a law firm with which the collaborative lawyer is associated, may represent a party or the party’s child only until the person is represented by a successor lawyer or reasonable measures are taken to protect the health, safety, welfare, or interest of the person.","path":["Title 6 Civil Practice.","Chapter 6 Remedies.","Article 1 Settlement of Controversies.","Division 4 Alabama Uniform Collaborative Law Act."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=6-6-26.08","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:53Z","sha256":"5c44b66066e5d6f3e12058381ee691c2b66e2a90c43278ae0e14fbeb5a21326c","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-6-6-26.07","next":"us-al/ala.-code-6-6-26.09"},"notice":"GroundRules: Original legal text.
