Code § 6-6-782","heading":"Notice and Opportunity for Hearing.","body":"(a) Except as otherwise provided in subsection (b), the court may issue an order under this article only after notice and opportunity for a hearing appropriate in the circumstances.\n(b) The court may issue a preliminary order under this article in any of the following circumstances:\n(1) Without prior notice if the circumstances require issuance of an order before notice is given.\n(2) After notice and without a prior hearing if the circumstances require issuance of an order before a hearing is held.\n(3) After notice and without a hearing, provided the court finds that the administration of justice will be preserved without a hearing.\n(c) Upon request by an interested party for rehearing of a preliminary order entered under subdivision (b)(1) or (b)(2), the court shall schedule a hearing to make the order final and in compliance with subsection (a).","path":["Title 6 Civil Practice.","Chapter 6 Remedies.","Article 18 Alabama Uniform Commercial Real Estate Receivership Act."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=6-6-782","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:54Z","sha256":"6324bc81c492aa8f028c681c127a988e6c9f19c3d8dcb16e4888d5d252105d85","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-6-6-781","next":"us-al/ala.-code-6-6-783"},"notice":"GroundRules: Original legal text.
