Code § 7-12A-302","heading":"Security Interest Perfected Before July 1, 2024.","body":"(a) Continuing perfection: perfection requirements satisfied. A security interest that is enforceable and perfected immediately before July 1, 2024, is a perfected security interest under Act 2023-492 if, on July 1, 2024, the requirements for enforceability and perfection under Act 2023-492 are satisfied without further action.\n(b) Continuing perfection: enforceability or perfection requirements not satisfied. If a security interest is enforceable and perfected immediately before July 1, 2024, but the requirements for enforceability or perfection under Act 2023-492 are not satisfied on July 1, 2024, the security interest:\n(1) is a perfected security interest until the earlier of the time perfection would have ceased under the law in effect immediately before July 1, 2024, or the adjustment date;\n(2) remains enforceable thereafter only if the security interest satisfies the requirements for enforceability under Section 7-9A-203, as amended by Act 2023-492, before the adjustment date; and\n(3) remains perfected thereafter only if the requirements for perfection under Act 2023-492 are satisfied before the time specified in paragraph (1).","path":["Title 7 Commercial Code.","Article 12A Transitional Provisions for Uniform Commercial Code Amendments (2022).","Part 3 Transitional Provisions for Articles 9A and 12."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=7-12A-302","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:54Z","sha256":"7e21ee90092947438ad24823b8de794b045f1b482742963fbd497120aa31317c","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-7-12a-301","next":"us-al/ala.-code-7-12a-303"},"notice":"GroundRules: Original legal text.
