Code § 8-19H-3","heading":"Manufacturer Liability.","body":"(a) A manufacturer of a device shall be subject to civil liability if all of the following occur:\n(1) A device is activated in the state.\n(2) The device does not, upon activation, enable a filter that complies with the requirements described in Section 8-19H-2.\n(3) A minor accesses obscene material on the device.\n(b) Notwithstanding subsection (a), this section does not apply to a manufacturer that makes a good faith effort to provide a device that, upon activation of the device in the state, automatically enables a filter on the device that complies with the requirements of Section 8-19H-2.\n(c) Nothing in this chapter does any of the following:\n(1) Applies to a device manufactured before October 1, 2025.\n(2) Applies to a video game console.\n(3) Creates a cause of action against a retailer of a device.","path":["Title 8 Commercial Law and Consumer Protection.","Chapter 19H Filter for Certain Internet-Enabled Devices."],"source_url":"https://alison.legislature.state.al.us/code-of-alabama?section=8-19H-3","current_through":"Act 2026-611","vintage":"","retrieved_at":"2026-09-03T14:01:54Z","sha256":"45a48b8ba79074ae92d563537d402d9c0e2b0ffd13bf4d45b96e363706b76b77","source_id":"us-al","stale":false,"prev":"us-al/ala.-code-8-19h-2","next":"us-al/ala.-code-8-19h-4"},"notice":"GroundRules: Original legal text.
