(2) Room and board costs shall also be borne by the state so long as the Arkansas State Hospital has actual physical custody of the defendant for the evaluation, observation, or treatment of the defendant. (b) (1) However, whenever an evaluation of the defendant has been completed, the county from which the defendant is sent for evaluation, within two (2) working days, shall procure the defendant from the Arkansas State Hospital. (2) Should the county fail to procure the defendant within this two-day period, the county shall bear all room and board costs on the third and subsequent days.
