Code Ann. § 20-17-209","heading":"Penalties","body":"(a) A physician or other healthcare provider who willfully fails to transfer in accordance with § 20-17-207 is guilty of a Class A misdemeanor.\n\n(b) A physician who willfully fails to record the determination of terminal condition or permanent unconsciousness in accordance with § 20-17-205 is guilty of a Class A misdemeanor.\n\n(c) An individual who willfully conceals, cancels, defaces, or obliterates the declaration of another without the declarant's consent or who falsifies or forges a revocation of the declaration of another is guilty of a Class A misdemeanor.\n\n(d) An individual who falsifies or forges the declaration of another, or willfully conceals or withholds personal knowledge of a revocation as provided in § 20-17-204 , is guilty of a Class D felony.\n\n(e) An individual who requires or prohibits the execution of a declaration as a condition for being insured for, or receiving, healthcare services is guilty of a Class D felony.\n\n(f) A person who coerces or fraudulently induces another to execute a declaration under this subchapter is guilty of a Class D felony.\n\n(g) The sanctions provided in this section do not displace any sanction applicable under other law.","path":["AR Code","Title 20","Chapter 17","Subchapter 2"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_ar_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:41Z","sha256":"2ae337c27084138d47b07e06c55ede5e3a5c6cf4077a94799c5dcc504e2e7dc0","source_id":"us-ar","stale":false,"prev":"us-ar/ark.-code-ann.-20-17-208","next":"us-ar/ark.-code-ann.-20-17-210"},"notice":"GroundRules: Original legal text.
