Code Ann. § 22-9-804","heading":"Public agency construction contracts - Prohibited terms","body":"A public agency that awards a contract for the construction, repair, remodeling, or demolition of a public improvement, or obligating funds pursuant to such a contract, shall ensure that neither the awarding public agency nor a construction manager acting on behalf of the public agency includes in its bid specifications, project agreements, or other controlling documents any of the following:\n\n(1) A term that requires, prohibits, encourages, or discourages bidders, contractors, or subcontractors from entering into or adhering to agreements with a collective bargaining organization relating to the construction project or a related construction project; or\n\n(2) A term that discriminates against bidders, contractors, or subcontractors based on the status as a party or nonparty to, or the willingness or refusal to enter into, an agreement with a collective bargaining organization relating to the construction project or a related construction project.","path":["AR Code","Title 22","Chapter 9","Subchapter 8"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_ar_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:41Z","sha256":"5bc94edd67ec6bb5670e3d229dfb1b380b753fee2c0e692cf86db7b09c520e68","source_id":"us-ar","stale":false,"prev":"us-ar/ark.-code-ann.-22-9-803","next":"us-ar/ark.-code-ann.-22-9-805"},"notice":"GroundRules: Original legal text.
