Code Ann. § 23-4-902","heading":"Exemption from rate case procedures, etc","body":"A co-op, as defined in § 23-4-901 , shall not be subject to rate case procedures and hearings and other requirements of §§ 23-4-402 - 23-4-405 , 23-4-407 - 23-4-418 , and 23-4-620 - 23-4-634 and Arkansas Public Service Commission rules implementary thereof, hereafter referred to as \"rate case procedures\", by the commission unless:\n\n(1) By action of its board of directors, the co-op elects to be subject to rate case procedures by the commission;\n\n(2) A proposed change in the co-op's rates and charges exceeds ten percent (10%) of total gross revenues;\n\n(3) Ten percent (10%) of the co-op's member-consumers petition the commission to apply rate case procedures; or\n\n(4) As otherwise provided in this subchapter.","path":["AR Code","Title 23","Chapter 4","Subchapter 9"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_ar_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:41Z","sha256":"e55e35a76e2a163097c60bfad8cdc918ce963aff14dd6c5dcba3ada4c5b83e66","source_id":"us-ar","stale":false,"prev":"us-ar/ark.-code-ann.-23-4-901","next":"us-ar/ark.-code-ann.-23-4-903"},"notice":"GroundRules: Original legal text.
