Code Ann. § 23-61-908","heading":"Penalties for failure to submit data","body":"(a) Except for state or federal agencies that are submitting entities, a submitting entity that fails to submit data as required by this subchapter or the rules of the State Insurance Department may be subject to a penalty.\n\n(b) The department shall adopt a schedule of penalties not to exceed one thousand dollars ($1,000) per day of violation, determined by the severity of the violation.\n\n(c) A penalty imposed under this section may be remitted or mitigated upon such terms and conditions as the department considers proper and consistent with the public health and safety.\n\n(d) A penalty remitted under this section shall be used for Arkansas Healthcare Transparency Initiative operations.","path":["AR Code","Title 23","Chapter 61","Subchapter 9"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_ar_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:41Z","sha256":"e489d75ba1936172708d7ffc3265124a3f7b78a1d526f75419bb7e06cb6d781a","source_id":"us-ar","stale":false,"prev":"us-ar/ark.-code-ann.-23-61-907","next":"us-ar/ark.-code-ann.-23-61-909"},"notice":"GroundRules: Original legal text.
