Code Ann. § 23-70-114","heading":"Method of determining financial condition","body":"In determining the financial condition of a reciprocal insurer, the Insurance Commissioner shall apply the following rules:\n\n(1) He or she shall charge as liabilities the same reserves as are required of incorporated insurers issuing nonassessable policies on a reserve basis;\n\n(2) The surplus deposits of subscribers shall be allowed as assets, except that any premium deposits delinquent for ninety (90) days shall first be charged against the surplus deposit;\n\n(3) The surplus deposits of subscribers shall not be charged as a liability;\n\n(4) All premium deposits delinquent less than ninety (90) days shall be allowed as assets;\n\n(5) An assessment levied upon subscribers, and not collected, shall not be allowed as an asset;\n\n(6) The contingent liability of subscribers shall not be allowed as an asset; and\n\n(7) The computation of reserves shall be based upon premium deposits other than membership fees and without any deduction for expenses and the compensation of the attorney.","path":["AR Code","Title 23","Chapter 70"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_ar_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:41Z","sha256":"e1584a0c6a5285ddf445ab548a119ff582512598d470bc6ffe9d60fc344b266f","source_id":"us-ar","stale":false,"prev":"us-ar/ark.-code-ann.-23-70-113","next":"us-ar/ark.-code-ann.-23-70-115"},"notice":"GroundRules: Original legal text.
