Code Ann. § 23-94-207","heading":"Purchasing groups - Exemption from certain laws","body":"A purchasing group and its insurer or insurers shall be subject to all applicable laws of this state, except that a purchasing group and its insurer or insurers shall be exempt, in regard to liability insurance for the purchasing group, from any law that would:\n\n(1) Prohibit the establishment of a purchasing group;\n\n(2) Make it unlawful for an insurer to provide or offer to provide insurance on a basis providing, to a purchasing group or its members, advantages based on their loss and expense experience not afforded to other persons with respect to rates, policy forms, coverages, or other matters;\n\n(3) Prohibit a purchasing group or its members from purchasing insurance on a group basis described in subdivision (2) of this section;\n\n(4) Prohibit a purchasing group from obtaining insurance on a group basis because the purchasing group has not been in existence for a minimum period of time or because any member has not belonged to the purchasing group for a minimum period of time;\n\n(5) Require that a purchasing group must have a minimum number of members, common ownership or affiliation, or certain legal form;\n\n(6) Require that a certain percentage of a purchasing group must obtain insurance on a group basis;\n\n(7) Otherwise discriminate against a purchasing group or any of its members; or\n\n(8) Require that any insurance policy issued to a purchasing group or any of its members be countersigned by an insurance agent or broker residing in this state.","path":["AR Code","Title 23","Chapter 94","Subchapter 2"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_ar_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:41Z","sha256":"3af5de8e9aa90bd06a6afaed560abb5afaa93e050f26ce4069841370b4557d1d","source_id":"us-ar","stale":false,"prev":"us-ar/ark.-code-ann.-23-94-206","next":"us-ar/ark.-code-ann.-23-94-208"},"notice":"GroundRules: Original legal text.
