Code Ann. § 28-73-414","heading":"Modification or termination of uneconomic trust","body":"(a) After notice to the qualified beneficiaries, the trustee of a trust consisting of trust property having a total value less than one hundred thousand dollars ($100,000) may terminate the trust if the trustee concludes that the value of the trust property is insufficient to justify the cost of administration.\n\n(b) A court may modify or terminate a trust or remove the trustee and appoint a different trustee if it determines that the value of the trust property is insufficient to justify the cost of administration.\n\n(c) Upon termination of a trust under this section, the trustee shall distribute the trust property in a manner consistent with the purposes of the trust.\n\n(d) This section does not apply to an easement for conservation or preservation.","path":["AR Code","Title 28","Chapter 73","Subchapter 4"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_ar_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:41Z","sha256":"a7cf8624b5e4ffb36c9bf56aaff9ac534366f1d898d6bd378fb886e31d4cf080","source_id":"us-ar","stale":false,"prev":"us-ar/ark.-code-ann.-28-73-413","next":"us-ar/ark.-code-ann.-28-73-415"},"notice":"GroundRules: Original legal text.
