Code Ann. § 5-36-404","heading":"Unlawful removal of a theft detection device","body":"(a) A person commits the offense of unlawful removal of a theft detection device if the person knowingly removes a theft detection device from merchandise prior to purchase with the intent to commit theft or retail theft. (b) (1) The unlawful removal of a theft detection device is a Class A misdemeanor. (2) A subsequent violation of this section is a Class D felony.
