Code Ann. § 5-39-204","heading":"Aggravated residential burglary","body":"(a) A person commits aggravated residential burglary if he or she commits residential burglary as defined in § 5-39-201 of a residential occupiable structure, and either: (1) The residential occupiable structure is occupied by another person; or (2) He or she is armed with a deadly weapon or represents by word or conduct that he or she is armed with a deadly weapon. (b) Aggravated residential burglary is a: (1) Class Y felony if: (A) Committed under subdivision (a)(2) of this section; or (B) The person causes or attempts to cause death or serious physical injury to another person; or (2) Class A felony if otherwise committed.
