Code Ann. § 9-13-404","heading":"Considerations of court","body":"To determine a matter under this subchapter, the court shall consider:\n\n(1) The best interests of the child;\n\n(2) The right of a parent for frequent and continuing contact with his or her child;\n\n(3) The rights of a custodian under an order from a court of competent jurisdiction in the State of Arkansas;\n\n(4) The risk of the child's becoming a victim of international child abduction by a parent, custodian, or any person acting on the behalf of the parent or custodian, based on the court's evaluation of the risk factors described in § 9-13-405 ;\n\n(5) Any obstacles to locating, recovering, or returning the child if the child is a victim of international child abduction; and\n\n(6) The potential physical or psychological harm to the child if the child is a victim of international child abduction.","path":["AR Code","Title 9","Chapter 13","Subchapter 4"],"source_url":"https://oss-data-us.vaquill.ai/v2026.08/us_ar_statutes.parquet","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:41Z","sha256":"97fdaa5499a64373930d0fc8b80e707f9935744f4ec402b54e31547b56d32d25","source_id":"us-ar","stale":false,"prev":"us-ar/ark.-code-ann.-9-13-403","next":"us-ar/ark.-code-ann.-9-13-405"},"notice":"GroundRules: Original legal text.
