If a declaration has not been made, declared gross weight means gross weight.\n\n2. \"Gross weight\" has the same meaning prescribed in section 28-5431.\n\n3. \"Motor carrier\" means a person who operates or causes to be operated a motor vehicle on a public highway.\n\n4. \"Motor vehicle\" means a self-propelled motor driven vehicle that has a declared gross vehicle weight of more than twelve thousand pounds and that is subject to vehicle registration before lawful operation on the public highways in this state, excluding a motor vehicle that is exempt from gross weight fees pursuant to section 28-5432.\n\n5. \"Public highway\" means any way or place in this state that is constructed or maintained with public monies and that is open to use by the public as a matter of right for the purpose of vehicular travel, including a highway under construction.","path":["Title 28 Transportation"],"source_url":"https://www.azleg.gov/ars/28/05851.htm","current_through":"2026-09-04","vintage":"2026-08-09","retrieved_at":"2026-09-04T00:49:56Z","sha256":"a69a9dd87471f79aae74e78c1a8c7e19a122e724ddd5b08d490024962ea9a560","source_id":"us-az","stale":true,"prev":"us-az/a.r.s.-28-5812","next":"us-az/a.r.s.-28-5852"},"notice":"GroundRules: Original legal text.
