{"data":{"id":"us-co/c.r.s.-13-21-1404","jurisdiction":"us-co","citation":"C.R.S. § 13-21-1404","heading":"Exceptions to liability - definitions.","body":"(1) In this section, unless the context otherwise requires:\n\n(a) \"Child\" means an unemancipated individual who is less than eighteen years of age.\n\n(b) \"Parent\" means an individual recognized as a parent under the law of this state other than this part 14.\n\n(2) A person is not liable under this part 14 if the person proves that disclosure of, or a threat to disclose, the intimate image was:\n\n(a) Made in good faith in:\n\n(I) Law enforcement;\n\n(II) A legal proceeding; or\n\n(III) Medical education or treatment; or\n\n(b) Made in good faith in the reporting or investigation of:\n\n(I) Unlawful conduct;\n\n(II) Unsolicited and unwelcome conduct;\n\n(III) Related to a matter of public concern or public interest; or\n\n(IV) Reasonably intended to assist the depicted individual.\n\n(3) Subject to subsection (4) of this section, a defendant who is a parent, legal guardian, or individual with legal custody of a child is not liable under this part 14 for a disclosure or threatened disclosure of an intimate image of the child.\n\n(4) If a defendant asserts an exception to liability under subsection (3) of this section, the exception does not apply if the plaintiff proves the disclosure was:\n\n(a) Prohibited by law other than this part 14; or\n\n(b) Made, possessed, or distributed for the purposes of sexual arousal, sexual gratification, humiliation, degradation, or monetary or commercial gain.\n\n(5) Disclosure of, or a threat to disclose, an intimate image is not a matter of public concern or public interest solely because the depicted individual is a public figure.","path":["Title 13 - COURTS AND COURT PROCEDURE","Article 21 - Damages","Part 14 - UNIFORM CIVIL REMEDIES FOR UNAUTHORIZED DISCLOSURE OF INTIMATE IMAGES"],"source_url":"https://olls.info/crs/crs2026-title-13.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"1dfdd12784c1449e189dcd5f810ab60311227b7b5d16f149db16b807fa65c91f","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-13-21-1403","next":"us-co/c.r.s.-13-21-1405"},"notice":"GroundRules: Original legal text.
