{"data":{"id":"us-co/c.r.s.-13-21-1506","jurisdiction":"us-co","citation":"C.R.S. § 13-21-1506","heading":"Remedies.","body":"(1) In a civil action filed pursuant to this part 15, a prevailing plaintiff may recover all of the following:\n\n(a) An amount equal to the monetary gain the defendant made from the creation, development, or disclosure of the intimate digital depiction;\n\n(b) Either of the following, whichever is greater:\n\n(I) The actual damages sustained by the depicted individual as a result of the intimate digital depiction's disclosure, including damages for emotional distress; or\n\n(II) Liquidated damages of one hundred fifty thousand dollars;\n\n(c) Exemplary damages; and\n\n(d) The cost of the action, including reasonable attorney fees and other litigation costs reasonably incurred.\n\n(2) In a civil action filed pursuant to this part 15, a court may, in addition to any other relief available pursuant to state law, order equitable relief, including a temporary restraining order, a preliminary injunction, or a permanent injunction ordering the defendant to cease disclosure of the intimate digital depiction.","path":["Title 13 - COURTS AND COURT PROCEDURE","Article 21 - Damages","Part 15 - PREVENTING UNAUTHORIZED DISCLOSURE OF INTIMATE DIGITAL DEPICTIONS ACT"],"source_url":"https://olls.info/crs/crs2026-title-13.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"52e96411bfebead172ba6134431e01112c39206d08989f96bac7506d8fffffa3","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-13-21-1505","next":"us-co/c.r.s.-13-21-1507"},"notice":"GroundRules: Original legal text.
