{"data":{"id":"us-co/c.r.s.-13-21-808","jurisdiction":"us-co","citation":"C.R.S. § 13-21-808","heading":"Effect of criminal drug conviction.","body":"(1) (a) A person against whom recovery is sought is estopped from denying participation in the marketing of illegal drugs if the person has a criminal conviction based on the same circumstances that are the basis for the claim for damages. Said conviction must be for other than mere possession of the specified illegal drug:\n\n(I) That is a felony under the \"Comprehensive Drug Abuse Prevention and Control Act of 1970\", 21 U.S.C. sec. 801, et seq.;\n\n(II) Under section 18-18-405 or 18-18-406, C.R.S.; or\n\n(III) That is a felony related to participation in the marketing of illegal drugs under the laws of another state.\n\n(b) Such a conviction is also prima facie evidence of the person's participation in the marketing of illegal drugs during the two years preceding the date of an act giving rise to a conviction.\n\n(2) The absence of a conviction of a person against whom recovery is sought does not bar an action against that person.","path":["Title 13 - COURTS AND COURT PROCEDURE","Article 21 - Damages","Part 8 - DRUG DEALER LIABILITY ACT"],"source_url":"https://olls.info/crs/crs2026-title-13.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"9da53ae450c9e9baa7c13be568d8e3ec3de8d15a518eaa9e51d17192daaad3d3","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-13-21-807","next":"us-co/c.r.s.-13-21-809"},"notice":"GroundRules: Original legal text.
