{"data":{"id":"us-co/c.r.s.-14-2-310","jurisdiction":"us-co","citation":"C.R.S. § 14-2-310","heading":"Unenforceable terms.","body":"(1) In this section, \"custodial responsibility\" means parental rights and responsibilities, parenting time, access, visitation, or other custodial right or duty with respect to a child.\n\n(2) A term in a premarital agreement or marital agreement is not enforceable to the extent that it:\n\n(a) Adversely affects a child's right to support;\n\n(b) Limits or restricts a remedy available to a victim of domestic violence under law of this state other than this part 3;\n\n(c) Purports to modify the grounds for a court-decreed legal separation or marital dissolution available under law of this state other than this part 3;\n\n(d) Penalizes a party for initiating a legal proceeding leading to a court-decreed legal separation or marital dissolution; or\n\n(e) Violates public policy.\n\n(3) A term in a premarital agreement or marital agreement which defines the rights or duties of the parties regarding custodial responsibility is not binding on the court.","path":["Title 14 - DOMESTIC MATTERS","Article 2 - Marriage and Rights of Married Persons","Part 3 - UNIFORM PREMARITAL AND MARITAL AGREEMENTS ACT"],"source_url":"https://olls.info/crs/crs2026-title-14.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"6cf061b28b09a84e23d850fb4ae26d6239345866a295fe2107bad185d9853ea7","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-14-2-309","next":"us-co/c.r.s.-14-2-311"},"notice":"GroundRules: Original legal text.
