{"data":{"id":"us-co/c.r.s.-15-16-809","jurisdiction":"us-co","citation":"C.R.S. § 15-16-809","heading":"Duty and liability of directed trustee.","body":"(1) Subject to subsection (2) of this section, a directed trustee shall take reasonable action to comply with a trust director's exercise or nonexercise of a power of direction or further power under section 15-16-806 (2)(a), and the trustee is not liable for the action.\n\n(2) A directed trustee must not comply with a trust director's exercise or nonexercise of a power of direction or further power under section 15-16-806 (2)(a) to the extent that by complying the trustee would engage in willful misconduct.\n\n(3) An exercise of a power of direction under which a trust director may release a trustee or another trust director from liability for breach of trust is not effective if:\n\n(a) The breach involved the trustee's or other director's willful misconduct;\n\n(b) The release was induced by improper conduct of the trustee or other director in procuring the release; or\n\n(c) At the time of the release, the director did not know the material facts relating to the breach.\n\n(4) A directed trustee that has reasonable doubt about its duty under this section may petition the court for instructions.\n\n(5) The terms of a trust may impose a duty or liability on a directed trustee in addition to the duties and liabilities under this section.","path":["Title 15 - PROBATE, TRUSTS, AND FIDUCIARIES","Article 16 - Trust Administration","Part 8 - COLORADO UNIFORM DIRECTED TRUST ACT"],"source_url":"https://olls.info/crs/crs2026-title-15.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"04edb58ec8c192238a6922682fd64cd54d4fe6ccb47a2ee66c48ad336ac2bc7e","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-15-16-808","next":"us-co/c.r.s.-15-16-810"},"notice":"GroundRules: Original legal text.
