{"data":{"id":"us-co/c.r.s.-15-16-811","jurisdiction":"us-co","citation":"C.R.S. § 15-16-811","heading":"No duty to monitor, inform, or advise.","body":"(1) Unless the terms of a trust provide otherwise:\n\n(a) A trustee does not have a duty to:\n\n(I) Monitor a trust director; or\n\n(II) Inform or give advice to a settlor, beneficiary, trustee, or trust director concerning an instance in which the trustee might have acted differently than the director; and\n\n(b) By taking an action described in subsection (1)(a) of this section, a trustee does not assume a duty excluded by subsection (1)(a) of this section.\n\n(2) Unless the terms of a trust provide otherwise:\n\n(a) A trust director does not have a duty to:\n\n(I) Monitor a trustee or another trust director; or\n\n(II) Inform or give advice to a settlor, beneficiary, trustee, or another trust director concerning an instance in which the director might have acted differently than a trustee or another trust director; and\n\n(b) By taking an action described in subsection (2)(a) of this section, a trust director does not assume the duty excluded by subsection (2)(a) of this section.\n\n(3) Unless the terms of a trust provide otherwise, section 15-5-1012 does not apply to a trust director.","path":["Title 15 - PROBATE, TRUSTS, AND FIDUCIARIES","Article 16 - Trust Administration","Part 8 - COLORADO UNIFORM DIRECTED TRUST ACT"],"source_url":"https://olls.info/crs/crs2026-title-15.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"b0000a04a9c971098dcd1617cff7c0b61315332791aafce49c93c2051c145c2f","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-15-16-810","next":"us-co/c.r.s.-15-16-812"},"notice":"GroundRules: Original legal text.
