{"data":{"id":"us-co/c.r.s.-15-5-1001","jurisdiction":"us-co","citation":"C.R.S. § 15-5-1001","heading":"Remedies for breach of trust.","body":"(1) A violation by a trustee of a duty the trustee owes to a beneficiary is a breach of trust.\n\n(2) To remedy a breach of trust that has occurred or may occur, the court may:\n\n(a) Compel the trustee to perform the trustee's duties;\n\n(b) Enjoin the trustee from committing a breach of trust;\n\n(c) Compel the trustee to redress a breach of trust by paying money, restoring property, being surcharged or sanctioned, or other means;\n\n(d) Order a trustee to account, provide a status or financial report, or provide an inventory;\n\n(e) Appoint a special fiduciary to take possession of the trust property and administer the trust;\n\n(f) Restrain, restrict, or suspend the trustee;\n\n(g) Remove the trustee as provided in section 15-5-706;\n\n(h) Reduce or deny compensation to the trustee or require the trustee to disgorge compensation previously paid;\n\n(i) Subject to section 15-5-1012, void an act of the trustee, impose a lien or constructive trust on trust property, or trace trust property wrongfully disposed of and recover the property or its proceeds; or\n\n(j) Order other appropriate relief.\n\n(3) If a remedy for a breach of trust is sought by a cotrustee, beneficiary, or interested person, or the court acts sua sponte, the provisions of part 5 of article 10 of this title 15 apply.","path":["Title 15 - PROBATE, TRUSTS, AND FIDUCIARIES","Article 5 - Colorado Uniform Trust Code","Part 10 - LIABILITY OF TRUSTEES AND RIGHTS OF PERSONS DEALING WITH TRUSTEES"],"source_url":"https://olls.info/crs/crs2026-title-15.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"b9569b183643505d9b4fccac5720a54b9cf5c2ed0a5ac3b57db5f87bf25d97a7","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-15-5-818","next":"us-co/c.r.s.-15-5-1002"},"notice":"GroundRules: Original legal text.
