{"data":{"id":"us-co/c.r.s.-15-5-706","jurisdiction":"us-co","citation":"C.R.S. § 15-5-706","heading":"Removal of trustee.","body":"(1) The settlor, a cotrustee, or a beneficiary may request the court to remove a trustee, or a trustee may be removed by the court on its own initiative.\n\n(2) The court may remove a trustee if:\n\n(a) The trustee has committed a serious breach of trust;\n\n(b) Lack of cooperation among cotrustees substantially impairs the administration of the trust;\n\n(c) Because of unfitness, unwillingness, or persistent failure of the trustee to administer the trust effectively, the court determines that removal of the trustee best serves the interests of the beneficiaries; or\n\n(d) (I) There has been a substantial change of circumstances or removal is requested by all of the qualified beneficiaries;\n\n(II) The court finds that removal of the trustee best serves the interests of all of the beneficiaries and is not inconsistent with a material purpose of the trust; and\n\n(III) A suitable cotrustee or successor trustee is available.\n\n(3) Pending a final decision on a request to remove a trustee, or in lieu of or in addition to removing a trustee, the court may order such appropriate relief pursuant to section 15-5-1001 (2) as may be necessary to protect the trust property or the interests of the beneficiaries.","path":["Title 15 - PROBATE, TRUSTS, AND FIDUCIARIES","Article 5 - Colorado Uniform Trust Code","Part 7 - OFFICE OF TRUSTEE"],"source_url":"https://olls.info/crs/crs2026-title-15.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"d31d757326690e66b517d7e2f421f1e470df6f26ebd533620a427863af7a07a8","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-15-5-705","next":"us-co/c.r.s.-15-5-707"},"notice":"GroundRules: Original legal text.
