{"data":{"id":"us-co/c.r.s.-16-12-201","jurisdiction":"us-co","citation":"C.R.S. § 16-12-201","heading":"Legislative declaration.","body":"(1) The general assembly hereby declares that the purpose of this part 2 is to establish an expedited system of unitary review of class 1 felony cases in which a death sentence is imposed.\n\n(2) The general assembly finds that enactment of this part 2 will accomplish the following goals:\n\n(a) Ensuring compliance with the requirements of the federal \"Antiterrorism and Effective Death Penalty Act of 1996\", 28 U.S.C. sec. 2261 et seq.;\n\n(b) Improving the accuracy, completeness, and justice of review proceedings by requiring that postconviction review commence immediately after the imposition of a sentence of death;\n\n(c) Allowing for the full and fair examination of all legally cognizable postconviction and appellate issues by the trial court and the Colorado supreme court; and\n\n(d) Eliminating, to the fullest extent possible, unreasonable and unjust delays in the resolution of postconviction issues by combining and reducing the number of proceedings in class 1 felony cases.","path":["Title 16 - CRIMINAL PROCEEDINGS","Article 12 - Review of Judgments in Criminal Cases","Part 2 - UNITARY REVIEW IN DEATH PENALTY CASES"],"source_url":"https://olls.info/crs/crs2026-title-16.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"063ff16c0458f0f830d8b918415230c33a0bac3a9005f2f9b39ca44777e36c1d","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-16-12-103","next":"us-co/c.r.s.-16-12-202"},"notice":"GroundRules: Original legal text.
