{"data":{"id":"us-co/c.r.s.-16-4-202","jurisdiction":"us-co","citation":"C.R.S. § 16-4-202","heading":"Appeal bond hearing - factors to be considered.","body":"(1) The court shall consider the following factors in deciding whether or not an appeal bond should be granted and determining the type of bond and conditions of release required:\n\n(a) The nature and circumstances of the offense before the court and the sentence imposed for that offense;\n\n(b) The defendant's length of residence in the community;\n\n(c) The defendant's employment, family ties, character, reputation, and mental condition;\n\n(d) The defendant's past criminal record and record of appearance at court proceedings;\n\n(e) Any showing of intimidation or harassment of witnesses or potential witnesses, or likelihood that the defendant will harm or threaten any person having a part in the trial resulting in conviction;\n\n(f) Any other criminal charges pending against the defendant and the potential sentences should the defendant be convicted of those charges;\n\n(g) The circumstances of, and sentences imposed in, any criminal case in which the defendant has been convicted but execution stayed pending appeal;\n\n(h) The likelihood that the defendant will commit additional criminal offenses during the pendency of such defendant's appeal; and\n\n(i) The defendant's likelihood of success on appeal.","path":["Title 16 - CRIMINAL PROCEEDINGS","Article 4 - Release from Custody Pending Final Adjudication","Part 2 - BAIL AFTER CONVICTION"],"source_url":"https://olls.info/crs/crs2026-title-16.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"c679566fcd1da89469563c873ffce3a8ab6173b0a8cd0402000bbfaf233424ac","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-16-4-201.5","next":"us-co/c.r.s.-16-4-203"},"notice":"GroundRules: Original legal text.
