{"data":{"id":"us-co/c.r.s.-18-18-421","jurisdiction":"us-co","citation":"C.R.S. § 18-18-421","heading":"Imitation controlled substances - determination - considerations.","body":"(1) In determining whether a substance is an imitation controlled substance, the trier of fact may consider, in addition to all other relevant factors, the following:\n\n(a) Statements by an owner or by anyone in control of the substance concerning the nature of the substance or its use or effect;\n\n(b) Statements made to the recipient that the substance may be resold for inordinate profit which is more than the normal markup charged by legal retailers of similar pharmaceutical products;\n\n(c) Whether the substance is packaged in a manner normally used for illicit controlled substances;\n\n(d) Evasive tactics or actions utilized by the owner or person in control of the substance to avoid detection by law enforcement authorities;\n\n(e) The proximity of the imitation controlled substance to any controlled substances when conduct purported to be illegal under this article is observed.","path":["Title 18 - CRIMINAL CODE","Article 18 - Uniform Controlled Substances Act of 2013","Part 4 - OFFENSES AND PENALTIES"],"source_url":"https://olls.info/crs/crs2026-title-18.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"fb5bc6a75a95de32851e6188db877447d85b59a6680fce606f3195fa29a2ce1a","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-18-18-420","next":"us-co/c.r.s.-18-18-422"},"notice":"GroundRules: Original legal text.
