{"data":{"id":"us-co/c.r.s.-18-3.5-104","jurisdiction":"us-co","citation":"C.R.S. § 18-3.5-104","heading":"Unlawful termination of pregnancy in the second degree.","body":"(1) A person commits the offense of unlawful termination of pregnancy in the second degree if the person knowingly causes the unlawful termination of the pregnancy of a woman.\n\n(2) (a) Except as otherwise provided in paragraph (b) of this subsection (2), unlawful termination of pregnancy in the second degree is a class 4 felony.\n\n(b) If unlawful termination of pregnancy in the second degree is committed under circumstances where the act causing the unlawful termination of pregnancy is performed upon a sudden heat of passion, caused by a serious and highly provoking act of the intended victim, affecting the person causing the unlawful termination of pregnancy sufficiently to excite an irresistible passion in a reasonable person, and without an interval between the provocation and the unlawful termination of pregnancy sufficient for the voice of reason and humanity to be heard, it is a class 5 felony.\n\n(3) A defendant convicted pursuant to subsection (1) of this section shall be sentenced by the court in accordance with the provisions of section 18-1.3-406.","path":["Title 18 - CRIMINAL CODE","Article 3.5 - Offenses Against Pregnant Women"],"source_url":"https://olls.info/crs/crs2026-title-18.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"284d04953be6dd44af595f428329a643e34c52435c100d95373f25d328946f24","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-18-3.5-103","next":"us-co/c.r.s.-18-3.5-105"},"notice":"GroundRules: Original legal text.
