{"data":{"id":"us-co/c.r.s.-18-4-409.5","jurisdiction":"us-co","citation":"C.R.S. § 18-4-409.5","heading":"Unauthorized use of a motor vehicle - definition.","body":"(1) A person commits unauthorized use of a motor vehicle if the person obtains or exercises control over the motor vehicle of another person without authorization of the owner and:\n\n(a) The person does not commit a criminal offense other than a misdemeanor traffic offense except eluding a police officer as described in section 42-4-1413 in the course of obtaining control over or in the exercise of control of a motor vehicle; and\n\n(b) The motor vehicle is returned to the owner or recovered by law enforcement within twenty-four hours after being reported as missing or stolen by the owner, with no damage to the motor vehicle.\n\n(2) Unauthorized use of a motor vehicle is a class 1 misdemeanor; except that a second or subsequent offense for a violation of this section is a class 5 felony.\n\n(3) As used in this section, unless the context otherwise requires, \"motor vehicle\" has the same meaning as defined in section 18-4-409.","path":["Title 18 - CRIMINAL CODE","Article 4 - Offenses Against Property","Part 4 - THEFT"],"source_url":"https://olls.info/crs/crs2026-title-18.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"ebc2e59bd6d55003217c3fd6a3a8c5a303690c7bb563468bc56447ec615c3ec4","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-18-4-409","next":"us-co/c.r.s.-18-4-410"},"notice":"GroundRules: Original legal text.
