{"data":{"id":"us-co/c.r.s.-18-6-201","jurisdiction":"us-co","citation":"C.R.S. § 18-6-201","heading":"Bigamy.","body":"(1) A married person who, while still married, marries or enters into a civil union in this state with another person commits bigamy, unless as an affirmative defense it appears that at the time of the subsequent marriage or subsequent civil union:\n\n(a) The accused reasonably believed the prior spouse to be dead; or\n\n(b) The prior spouse had been continually absent for a period of five years during which time the accused did not know the prior spouse to be alive; or\n\n(c) The accused reasonably believed that he or she was legally eligible to remarry or legally eligible to enter into a civil union.\n\n(1.5) A person who is a partner in a civil union, while still legally in a civil union, who marries or enters into another civil union in the state with another person other than a current partner in a civil union commits bigamy, unless as an affirmative defense it appears that at the time of the subsequent marriage or subsequent civil union:\n\n(a) The accused reasonably believed the prior partner to be dead; or\n\n(b) The prior partner had been continually absent for a period of five years during which time the accused did not know the prior partner to be alive; or\n\n(c) The accused reasonably believed that he or she was legally eligible to marry or legally eligible to enter into a civil union.\n\n(2) Bigamy is a class 2 misdemeanor.","path":["Title 18 - CRIMINAL CODE","Article 6 - Offenses Involving the Family Relations","Part 2 - BIGAMY"],"source_url":"https://olls.info/crs/crs2026-title-18.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"6163d233131da6dad5a424f390c38aef100afcc055a665abe3be94d0d7f86b57","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-18-6-101-to-18-6-105","next":"us-co/c.r.s.-18-6-202"},"notice":"GroundRules: Original legal text.
