{"data":{"id":"us-co/c.r.s.-30-20-1412","jurisdiction":"us-co","citation":"C.R.S. § 30-20-1412","heading":"Waste tire processors - requirements.","body":"(1) A waste tire processor shall, as specified by the commission by rule:\n\n(a) Establish and maintain financial assurance;\n\n(b) Register with the department;\n\n(c) Affix a decal required pursuant to section 30-20-1417 (1) to the required location;\n\n(d) Develop, maintain, keep available for inspection, and comply with an engineering design and operations plan, including a fire prevention and control plan, and a plan for emergency response;\n\n(e) Maintain records, including the manifests required by section 30-20-1417 (2), relating to the collection of waste tires;\n\n(f) Develop and maintain a closure plan;\n\n(g) Submit an annual report to the department; and\n\n(h) Complete and submit self-certification documentation as required by the department.\n\n(2) A waste tire processor is subject to the following:\n\n(a) A waste tire processor that is not also registered as a waste tire monofill shall not have at the processing facility at any one time more than the lesser of:\n\n(I) One hundred thousand waste tires;\n\n(II) The amount of waste tires allowed under local requirements; or\n\n(III) The amount of waste tires anticipated in the waste tire processor's financial assurance instrument.\n\n(b) Following a one-year accumulation period, the weight or volume of waste tires that are processed must be at least seventy-five percent of the total weight or volume of waste tires received and currently in storage over a three-year rolling average. The calculation and accumulation period specified in this paragraph (b) must be based on a measure approved by the commission by rule.\n\n(3) The department may issue a waiver relating to any requirement of this section.","path":["Title 30 - GOVERNMENT - COUNTY","Article 20 - Public Improvements","Part 14 - STRATEGIES FOR WASTE TIRES"],"source_url":"https://olls.info/crs/crs2026-title-30.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"698f44fbd2ac068b6773c1776cfcde0651af3a418d7c537564be1cb02a329550","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-30-20-1411","next":"us-co/c.r.s.-30-20-1413"},"notice":"GroundRules: Original legal text.
