{"data":{"id":"us-co/c.r.s.-31-12-603","jurisdiction":"us-co","citation":"C.R.S. § 31-12-603","heading":"Hearing - decree - proviso.","body":"(1) Upon the filing of such petition in the district court, the judge shall set a date for a hearing, not less than forty days nor more than sixty days thereafter. The clerk of the court shall serve a copy of the petition and a notice of the date and the time set for such hearing upon the mayor of the city at least thirty days prior to the hearing of such petition. Upon the hearing and proof of the facts set forth in the petition, the court shall determine whether the tracts of land should be disconnected from the city, and the court shall enter an order or decree accordingly.\n\n(2) The owners are not entitled to disconnect the land under the provisions of this part 6 when:\n\n(a) The city has maintained streets, lights, and other public utilities for a period of three years through or adjoining the tracts of land; or\n\n(b) The tracts of land are included within the boundaries of:\n\n(I) An urban renewal area described in an urban renewal plan approved pursuant to part 1 of article 25 of this title 31; or\n\n(II) A special district that, by its service plan or pursuant to an intergovernmental agreement, is or will be expected to provide service to the tract of land.\n\n(3) If an area has been annexed to a city for a period of two years and then successful action is undertaken to disconnect the area, the disconnected land shall be made subject to the applicable county's zoning resolution and map and other land development regulations within ninety days after the effective date of the disconnection as described in section 31-12-501 (5).","path":["Title 31 - GOVERNMENT - MUNICIPAL","Article 12 - Annexation - Consolidation - Disconnection","Part 6 - DISCONNECTION BY COURT DECREE - STATUTORY CITIES"],"source_url":"https://olls.info/crs/crs2026-title-31.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"0a20c95acf2b1e1ae77eb519e87363d525c9a4e807cd20a41e1624453e239dc3","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-31-12-602","next":"us-co/c.r.s.-31-12-604"},"notice":"GroundRules: Original legal text.
