{"data":{"id":"us-co/c.r.s.-4-2-326","jurisdiction":"us-co","citation":"C.R.S. § 4-2-326","heading":"Sale on approval and sale or return - rights of creditors.","body":"(1) Unless otherwise agreed, if delivered goods may be returned by the buyer even though they conform to the contract, the transaction is:\n\n(a) A \"sale on approval\" if the goods are delivered primarily for use; and\n\n(b) A \"sale or return\" if the goods are delivered primarily for resale.\n\n(2) Goods held on approval are not subject to the claims of the buyer's creditors until acceptance; goods held on sale or return are subject to such claims while in the buyer's possession.\n\n(3) Any \"or return\" term of a contract for sale is to be treated as a separate contract for sale within the statute of frauds section of this article (section 4-2-201) and as contradicting the sale aspect of the contract within the provisions of this article on parol or extrinsic evidence (section 4-2-202).\n\n(4) The provisions of this section shall not apply to the placement of works of fine art on consignment, which shall be governed by the provisions of part 1 of article 15 of title 6.","path":["Title 4 - UNIFORM COMMERCIAL CODE","Article 2 - Sales","Part 3 - GENERAL OBLIGATION AND CONSTRUCTION OF CONTRACT"],"source_url":"https://olls.info/crs/crs2026-title-04.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"b82b769404308212b5cb9b4f44445bde0b325afed1c39a2e79c1326e95d1e466","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-4-2-325","next":"us-co/c.r.s.-4-2-327"},"notice":"GroundRules: Original legal text.
