{"data":{"id":"us-co/c.r.s.-40-15-207","jurisdiction":"us-co","citation":"C.R.S. § 40-15-207","heading":"Reclassification of services and products.","body":"(1) (a) Notwithstanding any other provision of this title, upon its own motion or upon application by any person, the commission shall regulate, pursuant to part 3 of this article, specific telecommunications services regulated under this part 2 upon a finding that there is effective competition in the relevant market for such service and that such regulation under part 3 of this article will promote the public interest and the provision of adequate and reliable service at just and reasonable rates.\n\n(b) In determining whether effective competition for a specific telecommunications service exists, the commission shall make findings, after notice and opportunity for hearing, and shall issue an order based upon consideration of the following factors:\n\n(I) The extent of economic, technological, or other barriers to market entry and exit;\n\n(II) The number of other providers offering similar services in the relevant geographic area;\n\n(III) The ability of consumers in the relevant geographic area to obtain the service from other providers at reasonable and comparable rates, on comparable terms, and under comparable conditions;\n\n(IV) The ability of any provider of such telecommunications service to affect prices or deter competition; and\n\n(V) Such other factors as the commission deems appropriate.\n\n(c) In determining geographic areas under paragraph (b) of this subsection (1), the commission shall not be unduly restrictive.","path":["Title 40 - UTILITIES","Article 15 - Intrastate Telecommunications Services","Part 2 - REGULATED TELECOMMUNICATIONS SERVICES"],"source_url":"https://olls.info/crs/crs2026-title-40.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"f1ea835bd7e4d0a737852aaf6b7fe88cb9bcb6428ae5cd52d895c38bd2b1a5c3","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-40-15-206","next":"us-co/c.r.s.-40-15-208"},"notice":"GroundRules: Original legal text.
