{"data":{"id":"us-co/c.r.s.-7-60-107","jurisdiction":"us-co","citation":"C.R.S. § 7-60-107","heading":"Partnership determined - how.","body":"(1) In determining whether a partnership exists these rules shall apply:\n\n(a) Except as provided by section 7-60-116, persons who are not partners as to each other are not partners as to third persons;\n\n(b) Joint tenancy, tenancy in common, tenancy by the entireties, joint property, common property, or part ownership does not of itself establish a partnership, whether such co-owners do or do not share any profits made by the use of the property;\n\n(c) The sharing of gross returns does not of itself establish a partnership, whether or not the persons sharing them have a joint or common right or interest in any property from which the returns are derived;\n\n(d) The receipt by a person of a share of the profits of a business is prima facie evidence that the person is a partner in the business, but no such inference shall be drawn if such profits were received in payment:\n\n(I) As a debt by installments or otherwise;\n\n(II) As wages of an employee or rent to a landlord;\n\n(III) As an annuity to a surviving spouse or representative of a deceased partner;\n\n(IV) As interest on a loan, though the amount of payment varies with the profits of the business;\n\n(V) As the consideration for the sale of a goodwill of a business or other property by installments or otherwise.","path":["Title 7 - CORPORATIONS AND ASSOCIATIONS","Article 60 - Uniform Partnership Law"],"source_url":"https://olls.info/crs/crs2026-title-07.htm","current_through":"Colorado Revised Statutes 2026","vintage":"","retrieved_at":"2026-09-14T18:37:45Z","sha256":"664f8078ab2c06a2503f851f86b38579acf49397cac84dc120855508a85c01da","source_id":"us-co","stale":false,"prev":"us-co/c.r.s.-7-60-106","next":"us-co/c.r.s.-7-60-108"},"notice":"GroundRules: Original legal text.
